Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 341, 406, 494, 498A and 34 of the Indian Penal Code and Sections 3 and 4 of the D.P Act.

Learned counsel for the petitioner submits that from perusal of the office report dated 28-6-2024, it would manifest that the same records that the process server has reported that OP No. 2 has performed her second marriage and has gone away.

In view of the office report dated 28-6-2024, the

Patna High Court CR. MISC. No.59948 of 2023(6) dt.02-07-2024 2/2 notice is deemed to have been validly served. 5.

Learned counsel for the petitioner submits that petitioner, being husband, has been falsely implicated in the instant case. It is also submitted that OP No. 2 has performed her second marriage and is not interested in reviving her conjugal relationship.

Learned A.P.P. for the State, in view of the office report, does not in a position to oppose the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 507 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
