2. The petitioner seeks bail in connection with Baruraj P.S. Case No. 72 of 2023 instituted for the offences punishable under Sections 365/34 of the Indian Penal Code and later on chargesheet has been submitted under Sections 304B, 120B, 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

3. As per allegation in the FIR, it is case of dowry death due to non-fulfillment of dowry demand by the petitioner and his family members.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that petitioner is

He further submits that the name of the petitioner came before this case because the petitioner is the husband of the deceased. He next submits that there is no any material is found against the petitioner. He lastly submits that similarly situated co-accused persons have been granted bail by a Co-ordinate Bench of this Court. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 04.03.2025.

5. Learned APP for the State opposes the prayer for bail.

From perusal of the FIR, case diary, postmortem report and the impugned order of the learned Additional Sessions Judge-V, Muzaffarpur dated 19.06.2025, it appears that on the basis of written report of the informant-cum-father of the deceased, FIR has been registered under Sections 365/34 of the Indian Penal Code and later on chargesheet has been submitted under Sections 304B, 120B, 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act against four coaccused persons and the allegation is of dowry death due to nonfulfillment of dowry demand by the petitioner and his family members. it also appears that petitioner is the husband of the

No.52507 of 2025(3) dt.15-10-2025 3/3 deceased and he is working in the company for his livelihood out of the State because he is a labour and no specific allegation levelled against him. Similarly situated Co-accused persons namely Shila Devi and Mina Devi, have been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. Nos. 54819 of 2023 and 54713 of 2023 vide orders dated 17.10.2023 respectively, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Muzaffarpur in connection with Baruraj P.S. Case No. 72 of 2023.
