2. The petitioner has preferred this application for grant of regular bail in connection with Dhanaha P.S. Case No. 255 of 2024 dated 07.12.2024 registered for the offence/s punishable u/ss 8, 20(b) (ii) (B) and 29 of the NDPS Act.
3. As per the prosecution case, total 17 kgs ganja was recovered from the bag of the petitioner and the co-accused persons.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner was transpired in this case
Patna High Court CR. MISC. No.50599 of 2025(3) dt.15-10-2025 2/3 in the confessional statement of the co-accused, Markandey Patel. The said contraband is less than the commercial quantity. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has five criminal antecedents in which he is on bail in four cases as stated in para 3 of the bail petition. The petitioner is in custody since 09.06.2025. The co-accused person has already been granted regular bail by this Court vide order dated 17.03.2025 passed in Cr. Misc. No. 7745 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, West Champaran at Bettiah in connection with Dhanaha P.S. Case No. 255 of 2024, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
