JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2016 Heard Mr. Zeyaul Hoda, learned counsel for petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody since 26-03-2016 in G.R.P./Rail/Darbhanga P.S. Case No. 48 of 2016 registered for offence under Sections 47/57 of Bihar Excise (Amendment) Act, 2016 and Section 141 of the Railway Act, have prayed for grant of bail.

It has been submitted by learned counsel for petitioners that falsely recovery of about 20 bottles containing 750 ml. each foreign liquor was shown from the possession of petitioners.

In view of nature of accusation and period of custody,

Patna High Court Cr.Misc. No.32328 of 2016 (2) dt.19-08-2016 2/2 let both the aforesaid petitioners namely Md. Rabbani and Meer Md. Shahnawaz @ Shahnabaj be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Samastipur in connection with G.R.P./Rail/Darbhanga P.S. Case No. 48 of 2016.
