2. The petitioner, who is in custody since 25.10.2017, has renewed his prayer for bail in connection with Mehsi P.S. Case No. 321 of 2017 for the offence alleged under Sections 413, 414 and 34 of the Indian Penal Code having earlier been rejected by this Court by order dated 12.01.2018 in Cr. Misc. No. 2045 of 2018.

3. Learned counsel for the petitioner submits that in a subsequent development, charges have been framed by order dated 13.07.2018.

4. Be that as it may, considering that charges have been framed against the petitioner and having regard to the period of custody already suffered since 25.10.2017, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of 6th Additional Chief Judicial Magistrate, Motihari, East Champaran, in connection with Mehsi P.S. Case No. 321 of

Patna High Court Cr.Misc. No.53218 of 2018 (2) dt.29-08-2018 2017, on the following conditions - (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial. (iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
