ANJANA MISHRA ORAL ORDER 30-09-2015 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners nine in number are apprehending their arrest in connection with Kursakanta P.S. Case No.03 of 2015 registered under Sections 147,148,149,341,324,307,504,379 and 436 of the Indian Penal Code.

Learned counsel for the petitioners submits that admittedly an altercation took place regarding some obstruction created on the road, in which there was a free fighting between the parties. The allegations against the petitioners are general and omnibus in nature.

Learned counsel for the petitioners submits that apart from petitioner No.6, all other petitioners have no criminal antecedents.

So far as allegations against the petitioners are concerned, the same are general and omnibus in nature. Learned counsel for the State after perusal of the case diary submits that though there is no injury report on the record but the allegations against the petitioners seem to be general and omnibus in nature and the injuries purported to have been received do not attribute to any particular person.

Considering the aforementioned facts and circumstances, let the petitioners, above named, in the event of their arrest/surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.V.D. Dubey, Judicial Magistrate, Ist Class, Araria in connection with Kursakanta P.S. Case No.03 of 2015, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
