The petitioner seeks bail in connection with Harnaut P.S. Case No. 27/2021 instituted for the offences under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The husband of the informant was killed while returning home. The informant has expressed suspicion on
Patna High Court CR. MISC. No.51734 of 2022(2) dt.22-12-2022 2/3 one Arvind Singh and his two sons. The petitioner has neither been named in the F.I.R. nor any suspicion has been raised against him.
During the course of investigation, one Dheeraj is said to have made a confession naming the petitioner and two others. The two other persons, who have been named in the confession of aforesaid Dheeraj, have been granted bail by different Benches of this Court. Even Arvind Singh @ Arvind Kumar against whom suspicion was raised by the informant in the first instance, has been granted bail. The petitioner is in custody since 28.02.2022. It has been submitted that apart from the confession of aforesaid Dheeraj, there is no other material to connect the petitioner with the offence.
Regard being had to the afore-stated facts and also taking into account his clean antecedents, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda,
