The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and later on Section 302 of I.P.C. has been added.

The prosecution case in nutshell is that petitioner along with other co-accused persons, variously armed, came at the door of the informant and started assaulting the brother of informant, due to which he succumbed to injuries.

No.51405 of 2022(2) dt.17-01-2023 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that petitioner is languishing in judicial custody since 29.04.2022. There is case and counter case between the parties and in the background of land dispute the present case has been filed. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover, similarly situated coaccused persons have been granted Bail vide order dated 16.12.2022 in Cr. Misc. No. 48543 of 2022 by the coordinate Bench of this Court. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection
