Perused the order dated 03.02.2015 passed by Subordinate Judge-IV, Patna in Eviction Suit No. 02 of 2006 whereby the Court below rejected the application filed by the defendant petitioner to recall all the witnesses examined by the petitioner for cross-examination.

It appears that the Court below after considering the record and after hearing the parties recorded a finding that in fact this is a tactics adopted by the defendant to delay the eviction suit. In such way of the matter and considering the fact that this eviction suit is of year 2006, I do find any reason to interfere with the impugned order passed by the learned Court below.
