08-10-2018 Heard learned counsel for the petitioner.
The petitioner is seeking anticipatory bail in connection with Ziapokhar P.S. Case No. 11 of 2017 registered under Sections 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the name of the petitioner has transpired in the confessional statement of co-accused namely Prince Basak, Chote @ Mahfuz Alam who has been granted bail by the learned Additional Sessions Judge - 1st, Kishanganj.
It is submitted that the petitioner is not named in the F.I.R. and no incriminating articles has been recovered from his possession.
No one appears on behalf of the State.
In the facts and circumstances of the case
Patna High Court Cr.Misc. No.53147 of 2018 (2) dt.08-10-2018 whereunder it is submitted that the petitioner has no criminal antecedent and nothing has been recovered from his possession, in the event of his arrest/surrender before the court below within four weeks, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Kishanganj, in connection with Ziapokhar P.S. Case No. 11 of 2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
