The petitioner seeks bail in Sakra P.S. Case No. 328 of 2021, registered for the offence under Sections 307, 411/34 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.
As per the prosecution case, one person was caught by police and on search, one country-made pistol and two live cartridges were recovered from his possession and on interrogation, he disclosed his name as Dhiraj Kumar Jha as also the name of petitioner, who fled away from the place of occurrence.
It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of
Patna High Court CR. MISC. No.61959 of 2021(2) dt.15-02-2022 2/2 petitioner and he has been falsely implicated by co-accused Dhiraj Kumar Jha. Petitioner is in custody since 24.08.2021. Investigation is complete.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 12, Muzaffarpur / concerned court in connection with Sakra P.S. Case No. 328 of 2021.
