The petitioner apprehends his arrest in connection with Wazirganj P.S. Case No. 114 of 2014 registered for the offences punishable under Sections 364 and other Sections of the Indian Penal Code.
Learned counsel for the petitioner submits that name of the petitioner has been brought into the present case only because in the year 2013, Babu Chand Manjhi, the husband of the informant had lodged a case against the petitioner with regard to dispute having been occasioned on account of sale of fish in front of the house of the said informant. It is further submitted on behalf of the petitioner that it was one Tulsi Manjhi, who had in
Patna High Court Cr.Misc. No.5303 of 2015 (3) dt.27-04-2015 fact, persuaded the informant's husband to leave the house and disappeared thereafter. The name of the petitioner surfaced in this case merely because of the earlier dispute.
Considering the aforesaid submissions and also the fact that there is no cogent material on record, save and except the earlier case, let the petitioner, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 114 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. (Anjana Mishra, J) Jagdish/- U T
