JUSTICE SUDHIR SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Siwaipatti P.S.Case No. 78 of 2014 instituted under Sections 147, 148, 341, 448, 323, 379, 504 and 506 of the Indian Penal Code.
The prosecution story, in brief, is that on 25.06.2014 one Sigasan Devi gave fardbeyan before the police officer that on 22.06.2014 while she was cooking meal in her home at about 10.30 P.M., all of a sudden the accused persons went to her and said that she is a Dain. They were ready to assault her. Naresh Mahto was forcing to drink dirty thing. They assaulted her with brick and fist and slaps. The petitioner took Mangal Sutra from her neck. He took a sum of Rs. 15,000/- from the box of her shop.

It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent and he has falsely been implicated in this case. Further it is submitted that the petitioner and the informant are close agnates and due to land dispute the present case has been instituted against the petitioner. Further it has been submitted that so far offence under Section 379 of the Indian Penal Code is concerned, same is superficial. On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Siwaipatti P.S.Case No. 78 of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
