====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 09-11-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has renewed his prayer for grant of bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act. The earlier application for bail of the petitioner was rejected vide order dated 11.4.2022 passed in Cr. Misc. no.61685 of 2021.

As per the prosecution case, the accused persons are said to have come variously armed and the petitioner is said to have assaulted Basant Yadav with a khanti as a result of which he fell down unconscious.

It is submitted by learned counsel for the petitioner that a supplementary affidavit has been filed bringing on record

Patna High Court CR. MISC. No.52097 of 2022(3) dt.09-11-2022 2/2 as Annexure-1 to the said affidavit the order dated 1.11.2022 by which charge has been framed against the petitioner in the trial Court. It is further submitted that liberty was granted to the petitioner in the earlier order of rejection dated 11.4.2022 to renew his prayer for bail after four months or after framing of charge, whichever is later.

Having heard learned counsel for the parties and taking into consideration the observation granted in the earlier order of rejection dated 11.4.2022, charge having been framed against the petitioner on 1.11.2022 and the petitioner having remained in custody since 12.7.2021, the petitioner is directed to be enlarged on bail in connection with Dulhin Bazar P.S. Case no. 302 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge V, Danapur, District Patna.
