Petitioner apprehends arrest in connection with Kurhani P.S. Case No. 776 of 2021 registered for the offences under Sections 8, 20 and 22 of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that there is no recovery from his conscious possession. Petitioner has no criminal antecedent. Learned Additional Public Prosecutor appearing for the State opposes the prayer of bail and submits that there is recovery of 120 kg of Ganja from a hut which belongs to the petitioner. During investigation materials have come showing complicity of the petitioner in the alleged crime. He therefore,
Patna High Court CR. MISC. No.52195 of 2022(5) dt.27-03-2023 2/2 submits that petitioner does not deserve to be enlarged on anticipatory bail.
Considering the nature of allegation levelled against the petitioner and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for bail is accordingly rejected.
