JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 26.10.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is in jail since 31.8.2015 and earlier his prayer for bail was rejected by this court taking note of the allegation levelled against him but report of the trial court goes to show that up till now, only one prosecution witness has been examined and the trial of the petitioner is still pending for recording the evidence of prosecution witnesses.

In view of the aforesaid facts as well as submissions of the parties, prayer for bail of the petitioner in connection with Sessions Trial no. 268 of 2015/ 52 of 2016 arising out of Falka P.S. Case no. 18/2015 pending in the court of Addl. Sessions Judge I, Katihar is, again, rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible,

Patna High Court Cr.Misc. No.34312 of 2016 (3) dt.26-10-2016 preferably, within four months from the date of receipt/production of a copy of this order, failing which the petitioner may renew his prayer for bail before the trial court itslef.
