The petitioner is apprehending his arrest in connection with Chanpatia P.S.Case No.362/2017 dated 2.10.2017 registered for offences punishable under Sections 379 and 461 of the Indian Penal Code.
Allegation against the petitioner is of commission of theft of one motorcycle and it further appears that the same has been recovered from the house of the petitioner.
Submission of the learned counsel for the petitioner is that nothing has been recovered and and it has wrongly been mentioned that the same is not recovered from his house. Heard learned A.P.P. who has opposed the pryaer for anticipatory bail..
Having heard both sides and in view of the facts and
Patna High Court CR. MISC. No.51287 of 2019(2) dt.17-08-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, if the petitioner surrenders and pray for regular bail, the same shall be considered on the basis of materials available in the case diary while passing order for bail.
With the aforesaid direction, this application is dismissed.
