For the Petitioner/s : Mr. Raj Shekhar For the Respondent/s : Mr. R. B. Pd. Yadav ( AAG- XI ) ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2018 Heard learned counsel for the applicant and perused the record.
The applicant has preferred this review petition in connection with order dated 27.04.2017 passed in Civil Revision No. 168 of 2014.
Learned counsel appearing for the applicant submits that the petitioner had filed Reference Case No. 122 of 2010 in Bihar Public Works Contracts Disputes Arbitration Tribunal, Patna but the claim of the petitioner was dismissed by the Tribunal holding that his claim was time barred and against the aforesaid order, the applicant filed Civil Revision No. 168 of
Patna High Court C. REV. No.326 of 2017 (7) dt.26-09-2018 2/2 2014 but the aforesaid civil revision was, too, dismissed by this court. However, at the time of passing order dated 27.04.2017 in Civil Revision No. 168 of 2014, this court over-looked that final bill in respect of claim of the petitioner had not been prepared by the department as yet.
I do not find any substance in the submission of learned counsel of applicant and in my view, this review petition is liable to be dismissed on admission stage itself as there is no apparent error on the face of impugned order dated 27.04.2017. Accordingly, this review petition stands dismissed on admission stage itself.
