JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

In absence of petitioner, it has been alleged that the house of petitioner was searched and during course thereof, 134 bottles of country made wine each containing 200 ml were seized. From perusal of the written report, it is evident that at one occasion the informant had disclosed that he searched room after room but nothing was found. Nobody was there. On the other end, at the fag end of written report, it has been incorporated that only female members were present but surprisingly, they have got no presence over the seizure list. Apart from this, it is also evident that it happens to be the Chaukidar who had identified the house of the petitioner.

Patna High Court Cr.Misc. No.35615 of 2016 (2) dt.20-08-2016 Accordingly, petitioner, Shankar Manjhi is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 3rd Additional Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur PS case No.42/2016.
