2. The petitioner apprehends his arrest in a case registered for the offence under Section 103(2) of the Bhartiya Nyaya Sanhita, 2023.
3. As per FIR, informant's elder brother namely Brihaspati Yadav @ Rajendra Yadav left home on 07.11.2024 without informing anyone. It is further alleged that on 15.11.2024, the informant got an information that his elder brother had a fight and he opened fire whereupon the violent crowd surrounded him (informant's elder brother), abused & assaulted him badly and the local police took informant's elder brother to the DMCH for treatment where his brother succumbed to his injuries.

4. Learned counsel for the petitioner submits that F.I.R. was lodged against unknown and during course of investigation, name of the petitioner transpired. Petitioner has no involvement in this occurrence. The only material, which has come against petitioner, is that he was seen in the crowd, which is alleged to have killed the deceased. As a matter of fact, the deceased was a person with criminal background and due to that reason, he went to the office of Kameshwar Dharmik Nyas Rambagh, Darbhanga on 14.11.2024, where he created nuisance and on protest by some staffs, he opened fire, due to which, some persons sustained injury. Learned counsel for the petitioner further submits that during investigation, the I.O. of the case has mentioned in the inquest report that due to scuffle, deceased fell on the ground and died.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Darbhanga in connection with LNMU P.S. Case
