Petitioner seeks bail in a case registered under sections 399, 402 of the Indian Penal Code and sections 25 (I-b)a, 26,35 of the Arms Act.

Petitioner and other accused were caught on the spot while they had allegedly assembled to make preparation for committing dacoity and on being searched one loaded threenet and cartridges as well as some other articles were recovered from conscious possession of the petitioner but submission on behalf of the petitioner is that petitioner is in jail custody since long and almost all the other accused persons having similar allegation have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
