Petitioner seeks bail in Rupaspur P.S. Case No.09 of 2018 instituted for the offence under Section(s) 406, 420 Indian Penal Code and Section of Bihar Protection of Interest of Depositor Act, 2002.

Allegation in the written report is that the informant deposited rupees three lac in Furutrestic India Developer Ltd. on assurance of the petitioner that Company is not fake and if amount is misappropriated by the company, the petitioner will be liable to pay the amount by transferring the land. It is also alleged that petitioner also gave assurance in writing on plain paper. Later on, the informant came to know that company has

Patna High Court Cr.Misc. No.51138 of 2018 (2) dt.25-09-2018 2/2 misappropriated the amount and fled away and his money has been grabbed by the Company. It is further alleged that the petitioner has cheated the informant and misappropriated the amount.

Counsel for the petitioner submits that petitioner was only agent of that company. She has deposited the amount in the company with consent of the informant. There is no allegation of misappropriation against the petitioner. She is a lady and is in custody since 14.06.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 2nd Danapur, Patna, in connection with Rupaspur P.S. Case No.09 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- Rohit Kr.
