JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-10-2016 A supplementary affidavit has been filed on behalf of the petitioner, which is kept on record. Learned counsel for the petitioner is permitted to make necessary correction in para-1 of the petition. Heard.

Petitioner is not named in the First Information Report but it appears that the name of the petitioner came in the confessional statement of co-accused and except the aforesaid confessional statement as well as criminal antecedent, there appears to be nothing against the petitioner. Moreover, para-57 of the case diary goes to show that informant refused to participate in test identification parade. The investigation against the petitioner has already been completed.

Patna High Court Cr.Misc. No.28426 of 2016 (4) dt.18-10-2016 2/2 Considering the aforesaid facts and circumstances as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-IV, Gaya in connection with Delha P.S.Case No.100 of 2015.
