JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 13-07-2016 The present writ petition has been filed for directing the respondent-Bank to supply an up-to-date statement of account after adjusting the amount of the LIC bond of the petitioner as the proceeds have been received by the respondentBank; and to return the excess amount, if any, together with interest.

Pursuant to the order of this Court dated 04.07.2016, a supplementary counter affidavit has been filed on behalf of the respondent-Bank, paragraph 5 thereof discloses that as against the amount of Rs. 62,092/- by way of interest charged from the petitioner in the Housing Loan Account, a sum of Rs.

Patna High Court CWJC No.14345 of 2013 dt.13-07-2016 2/2 51,092/- has been credited to the petitioner's loan account earlier on 06.01.2014 and now the remaining amount of Rs. 11,000/- has also been credited on 11.07.2011 in the loan account. Learned counsel for the respondent-Bank, therefore, submits that the interest charged in the loan account owing to non-credit of LIC proceeds in time has now been credited back to the account of the petitioner.

3. In the above view of the matter and in the light of the statements made in paragraphs 5 and 6 of the supplementary counter affidavit of the respondent-Bank, the writ petition stands disposed. The respondent-Bank shall now proceed in the matter in accordance with law.
