2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 126(2), 115(2), 118(2), 190, 191(2), 191(3), 109, 103(1) and 329(4) of the BNS, registered in connection with Darbhanga Town P.S.Case No. 68/2025.

3. As per allegation, the petitioner and other accused persons armed with lathi, iron rod, sword etc. assaulted the brother of the informant brutally, as a result of which he died.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The FIR itself shows that there was dispute between the deceased and co-accused Pradeep Mandal. There was no dispute

Patna High Court CR. MISC. No.54448 of 2025(3) dt.20-01-2026 2/2 between the petitioner and the deceased, and no motive has been assigned for killing of the deceased against the petitioner. The allegations are general and omnibus. The petitioner is in custody for nine months.

5. On the contrary, the learned APP has opposed the prayer for bail by submitting that the eye-witnesses have supported the case against the petitioner and co-accused persons killed the deceased by inflicting brutal assault on him. 19 injuries have been found on the body of the deceased.

6. Considering the facts and circumstances of the case, presently, I am not inclined to grant the privilege of bail to the petitioner. It is accordingly rejected. (Nawneet Kumar Pandey, J) HR/- U T
