The petitioner seeks bail in connection with Paroo P.S. Case No.153 of 2014 registered under Section 304B/34 of the Indian Penal Code as well as Sections 3 and 4 of the Dowry Prohibition Act.
It is submitted by the learned counsel for the petitioner that during investigation it has transpired that at the time of marriage neither any dowry was demanded nor dowry was paid. The petitioner and his wife were having affair from before and it was a case of love marriage. It has also transpired during investigation that due to some minor differences and quarrel which took place between husband and wife the deceased tried to commit
Patna High Court Cr.Misc. No.35134 of 2016 (2) dt.20-08-2016 2/2 suicide by hanging herself to death. The moment the petitioner came to know, he took his wife to the local doctor for treatment and tried his best to save her life, but unfortunately, in course of treatment, the victim died.
Per contra, learned counsel for the State has opposed the prayer for grant of bail on the ground that the petitioner being husband is alleged to have killed his wife within seven years of marriage for non-fulfillment of demand of dowry. Regard being had to the submissions advanced at the Bar, the petitioner, namely, Amit Ranjan Kumar @ Amit Ranjan Singh, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., West Muzaffarpur, in connection with Paroo P.S.
