2. Petitioner seeks regular bail in connection with Ara Mufassil P.S. Case No.105 of 2019 registered under Section 366(A) of I.P.C.

3. As per prosecution case, on the alleged date of occurrence i.e. 28.03.2019, the minor daughter of the informant was taken away by the petitioner who was giving tuition to the victim. It is alleged that the petitioner was secretly talking to the daughter of the informant on her mobile.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The victim of the case was major at the time of occurrence as her date of birth is 10.02.1997. In support thereof, petitioner

Patna High Court CR. MISC. No.51693 of 2025(2) dt.11-08-2025 2/2 has filed a copy of Aadhar Card of the victim. It is further submitted that due to love affairs between them, they solemnized marriage having two children and she is living with the petitioner. In her statement under Section 164 Cr.P.C., the victim has not made any allegation against the petitioner and she has stated that without any pressure, she has solemnized marriage with the petitioner having two children out of the said wedlock. Petitioner has no criminal antecedent and he is in jail since 09.06.2025. Petitioner undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 6th -cumExclusive Special Judge, POCSO, Bhojpur at Ara in connection with Ara Mufassil P.S. Case No.105 of 2019.
