JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioner and co-accused, Sonu Singh are said to have assaulted the injured, Rajesh Pathak by means of sword causing injury on his head. Anenxure-2 to this petition goes to show that injured, Rajesh Pathak sustained altogether two injuries on his person. One injury was found on his forehead and another injury was found on his left little finger. The injury found on the forehead was simple whereas injury found on left little finger was grievous in nature. There is case and counter case between the
Patna High Court Cr.Misc. No.28447 of 2016 (3) dt.30-09-2016 2/2 parties and persons from both the sides appears to have sustained injury.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S. Case No. 79 of 2016.
