The petitioner seeks bail in Gaya Kotwali P. S. Case No. 586 of 2017 instituted for the offence under Section(s) 147, 148, 149, 341, 323, 324 and 307 Indian Penal Code. Learned counsel for the petitioner has submitted that the occurrence has taken place due to land dispute. In the written report, it is alleged that on the date of occurrence when the informant and his son found few people were playing gambling on the land which has been purchased by the informant, the informant raised protest then this petitioner assaulted the son of the informant with spade on his head. Patna High Court Cr.Misc. No.53718 of 2018(3) dt.03-10-2018 2/2 Kumar @ Kunal Kaushal is annexed as Annexure 2 wherein the doctor has found one sharp cut injury on his head 3"x 1⁄2" x skin Deep caused by sharp weapon and opinion was kept reserved.

Petitioner is in custody since 11.7.2018 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Gaya, in connection with Gaya Kotwali P. S. Case No. 586 of 2017 subject to the condition that both the bailers shall be the close relative of the petitioner.
