The petitioner apprehends his arrest in Chapra Town P.S. Case No.637 of 2018 registered under Sections 307, 379 and other sections of the Indian Penal Code.

The informant alleged that the petitioner and others entered into his shop and assaulted him and took away the entire articles from his shop. The petitioner and Ranjit Rai are alleged to have pressed the neck of the informant and stabbed him on the back.

Learned counsel for the petitioner submits that one stab injury was found on the back of the informant, which is opined to be simple in nature. Chandan Rai (petitioner) and Ranjit Rai are alleged to have given blow with knife but only one injury was found. It is submitted that Ranjit Rai has already

Patna High Court CR. MISC. No.47660 of 2019(2) dt.31-07-2019 2/2 been granted anticipatory bail by a coordinate bench of this court in Cr.Misc.No.22112 of 2019. The case of the petitioner stands on similar footing.

Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Chapra Town P.S. Case No.637 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
