Mr. Shyam Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 308(5), 352, 351(2) and 3(5) of the B.N.S..

3. As per prosecution case, it is alleged that this petitioner, along with other F.I.R. named accused persons, harvested and carried away the entire crop from the field of informant and also assaulted and demanded Rangdari of Rs. 1,80,000/-.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, the land in question was purchased by this petitioner from brother of informant after payment of due

No.51667 of 2025(2) dt.19-09-2025 2/2 consideration money and a title suit bearing Title Suit No. 263 of 2024 is also pending between informant and his brother before the learned Sub-Judge-IV, Bhojpur at Ara in which this petitioner is also a party. None of the acts allegedly committed by this petitioner would give rise to any criminal liability. Charge-sheet has already been submitted and petitioner is in custody since 31.03.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bhojpur at Ara in connection with Charpokhari P.S.
