The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323/341/420/467/468/471/504/506/34 of the Indian Penal Code. It is alleged that the petitioner no.1 being the Secretary of Madarsa Jahura-e- Islam 523 got his son i.e. petitioner no.2 appointed as teacher on the basis of fraudulently by getting forged signature of the informant on the resolution. It is submitted by learned counsel for the petitioners that petitioner no.1 being Secretary of Madarsa lodged a case against the informant at earlier point of time hence, the present case has been lodged. Subsequently, the informant has retracted from initial version and has filed a petition to that effect before
Patna High Court Cr.Misc. No.11285 of 2015 (2) dt.28-04-2015 2/2 learned court below which is annexed as annexure-3 to the petition. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Pothia (Paharkatta) P.S. Case No.32 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
