JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

The informant claims that while he was at railway station, two persons met him and disclosed their name as Ramzan Khan and Umesh Sahni and after that Ramzan Khan gave intoxicated biscuit to him as a result whereof he became unconscious and found himself in village Jitpur Banjaria. In course of investigation, some villagers claimed to have seen the petitioner in the company of informant prior to his recovery. It is

No.33855 of 2016 (3) dt.22-10-2016 2/2 admitted fact that petitioner was not known to the informant prior to the alleged occurrence and the person, who gave intoxicated biscuit to him, himself disclosed his name but even then police did not take pain to put the petitioner on Test Identification Parade. Moreover, the investigation against the petitioner appears to have already been completed and he does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Anwar Shamin, Judicial Magistrate 1st Class, Bagaha, West Champaran in connection with Semara P.S.
