The grievance of the petitioner in the present writ application is non-payment of salary despite regularization of the service of the petitioner.

Learned counsel for the petitioner submits that the petitioner is regularly working, yet the arrears as well as current salary is not paid.

Taking work and denying salary amount to begari, which is violation of Article 23 of the Constitution of India. If the petitioner has been regularized and he is performing his

Patna High Court CWJC No.15789 of 2019(4) dt.05-08-2019 2/2 responsibility, he is entitled for payment of salary. The claim of the petitioner requires factual inquiry at the level of the University.

Accordingly, the writ application is disposed of with a direction to the Registrar of the University to enquiry into the matter and on verification if the service of the petitioner is found regular he should be paid salary (arrears as well as current) at the earliest preferably within a period of 60 days from the date of receipt/production of a copy of this order.
