The petitioners seek bail in connection with Chandi P.S. Case No. 87 of 2018 dated 05.04.2018 instituted for the offences under Sections 25 (1-b)a, 26 & 35 of the Arms Act.

Learned counsel for the petitioners submits that petitioner no. 1 and 2 are in custody since 13.05.2018 whereas petitioner no. 3 is in custody since 10.04.2018. From their respective houses, pistols and cartridges were recovered but behind their back.

Learned counsel for the petitioners has submitted that the aforesaid weapons were planted and they have been falsely implicated in this case. The

Patna High Court Cr.Misc. No.54521 of 2018(2) dt.04-09-2018 2/2 aforesaid contention of the petitioners, it has been argued, can be gleaned from the fact that the petitioners do not have any criminal antecedents.

Considering the period of custody of the petitioners and nature of accusation, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- 1st, Hilsa in connection with Chandi P.S.
