JUSTICE SUDHIR SINGH ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 363 and 366(A)/34 of the I.P.C. The prosecution story, in brief, is that on the alleged date and time of occurrence the daughter of the informant, namely, Pooja Kumari, aged about 14 years, had gone to tuition but she did not return to her home. During search one Mahadeo Rai and Mukesh Rai informed the informant that they have seen his daughter on a motorcycle with Ravindra Mahto i.e. the petitioner and Rupesh Kumar. It is further alleged that Rupesh Kumar along with his friend Ravindra Mahto came to Buniadi tola and took her with them on allurement.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.30367 of 2016 (3) dt.09-09-2016 2/2 the petitioner is in custody since 29.4.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation is against co-accused Rupesh Kumar, who was in love affair with the victim and the victim eloped with the co-accused. Since the petitioner is a co-villager of the victim and was known to both the parties, for the said reason he has been made accused in the present case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sitamarhi in connection with Riga P.S. case No.235 of 2015.
