The petitioner seeks bail in Gaya Rail P.S. Case No. 137/2018, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.
It is alleged in the written report that the informant was coming from Aligarh by train. When he got down from train at Gaya platform, he found Rs. 2,000/- missing from his pocket. The informant reported the matter to G.R.P. and raised suspicion against petitioner as he was sitting with him and recovered the money hidden in the shoe of petitioner.
Learned counsel for the petitioner has submitted that petitioner has clean antecedent. There is no identification mark on
Patna High Court Cr.Misc. No.55301 of 2018 (2) dt.20-09-2018 2/2 the aforesaid note to support that the same belongs to informant. No incriminating article has been recovered from possession of this petitioner.
The petitioner is in custody since 23.05.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Railway Court, Gaya in connection with Gaya G.R.P. Case No. 137/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
