The petitioner seeks bail in Hajipur Town P.S. Case No.233 of 2018, registered under Sections 399 and 402 of the Indian Penal Code and 25(1-B)a, 26II and 35 of the Arms Act. The petitioner was apprehended while allegedly he was preparing to commit cognizable offence along with other accused persons and one country made pistol is said to have been recovered from possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is in jail since 09.04.2018. The petitioner has already remained in jail for 11⁄2 years.

Of course, the petitioner has got criminal antecedents and he is also accused in Hajipur Town P.S. Case No.218 of 2018, registered under Section 302 and other sections of the Indian Penal

Patna High Court CR. MISC. No.48829 of 2019(4) dt.16-11-2019 2/2 Code and 27 of the Arms Act but for recovery of one loaded country made pistol, the petitioner has already remained in jail for 11⁄2 years.

Taking into consideration the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Hajipur Town P.S. Case No.233 of 2018.
