JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and State. The petitioner is custody in connection with Khajekalan P.S. case no. 51 of 2018 for the offence under Sections 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is undergoing treatment at the clinic of renowned Neurologist Dr. (Prof.) Binay Karak. The petitioner is in custody since 04.07.2018. He further submits that the arms was not recovered from his conscious possession, but behind his back on the next day of the alleged incident and, as such, the petitioner deserves grant of bail.

Considering the totality of the facts situation, the

No.54686 of 2018 (2) dt.20-09-2018 2/2 petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each after 04.11.2018 to the satisfaction of Sub-Divisional Judicial Magistrate, Patna City, Patna in connection with Khajekalan P.S. case no. 51 of 2018.
