JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 The present application has been filed for modification of the order dated 07.05.2014 passed by a coordinate Bench of this Court(now retired) in Cr. Misc. No. 12214 of 2014 to the extent of modification in the condition imposed.

The petitioner was granted anticipatory bail in connection with Kotwali(Patna) P.S. Case No. 485 of 2013 on condition to appear before learned Court below physically on each and every date at least for two years or till disposal of the case.

It is submitted by learned counsel for the petitioner that petitioner works outside the State. Hence, it is difficult for him to be present on each and every date before learned Court below. It is further submitted that till date the petitioner has not defaulted a single day to appear before

Patna High Court Cr.Misc. No.13994 of 2015 (4) dt.28-04-2015 2/2 learned Court below.

On the ground mentioned in the modification application, the order dated 07.05.2014 passed in Cr. Misc. No. 12214 of 2014 is modified to the extent that learned Court below will be at liberty to cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during trial.

The order dated 07.05.2014 stands modified to the extent indicated above.

Accordingly the modification application is disposed off in connection with Kotwali(Patna) P.S. Case No. 485 of 2013, pending in the Court of learned Chief Judicial Magistrate, Patna.
