The petitioner apprehends his arrest in connection with Complaint Case No. 13328 of 2014, registered under Sections 120(B), 420, 409, 467, 471 and 474/34 of the Indian Penal Code.
The accusation is that petitioner being the Revenue Clerk in collusion with the other accused named in the complaint petition issued rent receipt in their favour in respect to land of the complainant.
Learned counsel for the petitioner submits that the petitioner being Revenue Clerk issued rent receipt of the land
Patna High Court CR. MISC. No.49608 of 2019(2) dt.08-08-2019 2/2 on the basis of report of the C.I. Further submission is that while rent receipt was issued in the year 2009, but the complainant/O.P. No.2 has not challenged the same before any higher authority and filed the present complaint petition. Moreover, the petitioner has retired from the post of Revenue Clerk in the year 2016. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Complaint Case No. 13328 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
