18-08-2016 Heard Sri Vikram Singh, learned counsel for the petitioner and Sri Amit Kumar Rakesh, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Gopalpur P.S. Case No. 13 of 2016 registered for offences under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504 & 576 of the Indian Penal Code and subsequently, Section 302 of the Indian Penal Code was added, has prayed for grant of bail. Learned counsel for the petitioner, by way of referring to Annexure - 1 to the petition i.e. copy of F.I.R., submits that in the F.I.R., save and except the allegation that petitioner was also present at the place of occurrence, there is no specific accusation against the petitioner, whereas, the informant had specifically

Patna High Court Cr.Misc. No.32197 of 2016 (2) dt.18-08-2016 2/2 alleged regarding overt act against some of the accused persons. So far as petitioner is concerned, there is nothing. He submits that it can hardly be a case of general and omnibus allegation. Learned Addl. Public Prosecutor though has opposed the prayer for bail, he does not dispute the submission of the learned counsel for the petitioner that there is no specific accusation against the petitioner.

Keeping in view the nature of accusation as well as the fact that the petitioner is lady, let the petitioner namely Sajani Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia (Bhagalpur) in connection with Gopalpur P.S. Case No. 13 of 2016.
