02. In the present case, the petitioner is apprehending his arrest in connection with Muzaffarpur Sadar P.S. Case No. 667 of 2022, registered on 25.10.2022, for the alleged offence under Sections 342, 323, 324, 506, 504, 307, 379/34 of the Indian Penal Code.

03. As per prosecution case, the petitioner and coaccused persons assaulted the informant and the petitioner stabbed the informant on his left arm and back. They also assaulted the wife of the informant.

04. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this

The allegation against the petitioner is that he gave knife blow to the informant but there is no injury report on record though a treatment paper is on record. If any injury has been caused, the injury would be taken to be simple. Moreover, with the intervention of Gram Panchayat, the matter has been compromised between the parties. The petitioner is having clean antecedent.

05. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the relationship of the parties and further considering the absence of injury report and subsequent event, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 667 of 2022, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
