====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 19-08-2023 Heard Mr. Shiva Shankar Sharma, learned counsel appearing on behalf of the petitioners and Mrs. Renu Kumari, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Sour Bazar P.S. Case No. 206 of 2021 registered for the offence punishable under Sections 304(B), 120(B) and 201/34 of the Indian Penal Code.
3. The allegation is of committing murder of the daughter of the informant by her in-laws including the petitioners for non-fulfillment of demand of dowry.
4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they

Petitioners are distant agnate of the son-in-law of the informant namely Akhilesh Sada and they have no concern with the family affairs of said Akhilesh Sada who is the husband of the deceased. Petitioner no.1 is the wife of petitioner no.2. Due to enmity, they have been named in the F.I.R. No specific allegation has been levelled against them.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Considering the nature of allegation levelled against the petitioners, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 206 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) mantreshwar/- U T
