JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-07-2015 It is submitted that Petitioner no. 2, Satyendra Bhuiyan has already been arrested.
Accordingly, the anticipatory bail petition of Petitioner no. 2 is dismissed.
Heard both sides.
The petitioners apprehend their arrest in Aurangabad Muffasil P.S. Case No. 79 of 2013, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
Patna High Court Cr.Misc. No.21658 of 2015 (2) dt.07-07-2015 2/2 The informant named the petitioners and other accused persons and alleged that Ram Nandan Bhuiyan is not petitioner. He has assaulted him with garasa on his head. It is submitted that there is no specific allegation of assault against the petitioners. The informant got one injury on his head. No other person was injured. Ramnandan Bhuiyan has already been enlarged on bail vide order passed in Cr. Misc. No. 31579/2013.
Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Muffasil P.S. Case No. 79 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
