JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-04-2021 Heard Mr. Uday Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Nanpur P.S. Case No. 180 of 2020, dated 03.06.2020, instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30, 30(a), 38(i), (ii) and 41 of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.8130 of 2021(2) dt.07-04-2021 2/3 On the tip off to the police, six places were raided and from there, liquor and other excisable items were recovered. With respect to one of the vehicles from which recovery has been made, it was told to the police party that the petitioner had run away at the time of raid. It has been submitted on behalf of the petitioner that apart from the aforesaid vague statement made by the co-villagers before the police, there is no other material to connect him with the offence. The petitioner has got no concern whatsoever with the motorcycle which was seized in the raid.

The petitioner does not have criminal antecedents. Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District and Sessions Judge-Cum-Special Judge (Excise), Sitamarhi, in connection
