Patna High Court L.P.A No.605 of 2021(20) dt.18-02-2025 2/2 the order dated 26.06.2019 passed in CWJC No. 12550 of 2019 on the score that even though appellants have been arrayed as necessary and proper party in CWJC No. 12550 of 2019 whereas the learned Single Judge has committed error to the extent of deciding the matter without issuing notice to the appellants, who are the contesting respondents in CWJC No. 12550 of 2019, therefore, on this short ground the appellants have made out a case so as to interfere with the learned Single Judge order dated 26.06.2019 and it is set aside and CWJC No. 12550 of 2019 stands restored.

2. Registry is requested to list CWJC No. 12550 of 2019 before the concerned Roster Bench at the earliest in view of the fact that submission made by the contesting respondent that the grievance of the appellants does not survive for consideration in view of later development.

3. With the above observation, present LPA No. 605 of 2021 stands disposed of.
