Mr.Ajay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Birpur P.S. Case No. 70/2019, instituted for offence under Section(s) 399, 402 of the Indian Penal Code read with Sections 26/35 of Arms Act. As per written report police/informant got information that Babu Saheb Sahni and 5-6 unknown criminals are planning for committing dacoity. The police reached at the place of occurrence and saw six persons were sitting on a Chouki and one person having country made pistol in his hand was standing. All the persons started running away seeing the police party but six persons including this petitioner were apprehended. It is alleged that one mobile phone has been recovered from possession of petitioner.

Patna High Court CR. MISC. No.47932 of 2019(2) dt.08-08-2019 2/2 Seizure-list is part of F.I.R. from which it appears that nine live cartridges have been recovered from the Chouki. Petitioner is in custody since 23.05.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Begusarai, in connection with Birpur P.S. Case No. 70/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
