Petitioner's college has temporary affiliation, both from the Jai Prakash University, Chapra as well as the State. It is the assertion of the counsel for the petitioner that they have requisites, where with all, for a permanent affiliation, but since the State and the university is dragging their feet and not taking a final decision for grant of regular affiliation, obviously, it is proving detrimental to the growth as well as standards of the college, in question.
Patna High Court CWJC No.7630 of 2015 dt.01-04-2016 2/2 The Court will not go by what has been stated by the petitioner with regard to the infrastructure etc., which is already in question, which makes it eligible for such grant of permanent affiliation, because those are verifiable issues by the competent authority by making a spot enquiry and verification. Since the matter of permanent affiliation has been vexing the institution for more than six to seven years now and such a position cannot be allowed to be continued indefinitely, the Court does give a direction upon the Vice-Chancellor of Jai Prakash University, Chapra as well as the Director, Higher Education, Government of Bihar, Patna that a decision with regard to permanent affiliation to the college, in question, must be taken in accordance with the law within a period of four months from the date of communication / production of a copy of this order. Writ application stands disposed off with above direction. It is made clear that the time-frame fixed by this Court must be adhered to in letter and spirit.
