JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioners and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioners and other accused were pressurizing the informant's father to withdraw a case, which had earlier been lodged, and when the informant's father refused to withdraw the same, at the instigation of co-accused Ashok Jaiswal, petitioners and two others are said to have caught the informant's father whereas the co-accused Rinku David opened fire causing death of informant's father.

Submission on behalf of the petitioners is that coaccused Ashok Jaiswal, who seems to be an order giver, has already been granted privilege of bail by a co-ordinate Bench of this Court and, moreover, the previous case is said to be lodged by

Patna High Court Cr.Misc. No.29744 of 2016 (2) dt.28-07-2016 2/2 deceased against the petitioners. It is further submitted that petitioners run a fruit shop near the shop of the deceased and that is the reason of false implication of the petitioners in the present case.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,-III, Siwan in connection with Mairwa P.S. case No. 182 of 2015/G.R.
